The father of the two boys who survived a fire in Northwest Indiana last year is asking a judge to release him from prison early to take care of them.
James Collins, 29, is behind bars for beating Jennifer Teel, the mother of the boys, back in September 2010, according to the Northwest Indiana Times.
Teel died during the fire that engulfed her home in Lake Station, Ind. on Dec. 10, but her two boys, 3-year-old Andrew Collins and 1-year-old brother Landon Teel survived.
The boys are now in the care of their grandmother.
Collins is expected to be released from prison on Nov. 19, 2013, but his lawyers filed a motion hoping to get him out of jail earlier than expected, according to the Northwest Indiana Times.
His lawyers are using testimony from Teel, in which she says the beating was an isolated act and he was fit to care for the children.
