Drew Peterson wants out of jail.

Peterson's attorneys plan to file a motion Monday asking he be released while the appellate court makes a decision critical to moving his trial forward, the Shorewood Patch reports.

Peterson was ready to stand trial almost a year ago on charges he murdered his third wife when prosecutors filed an appeal over what hearsay evidence could be used.

Peterson is accused of murdering his third wife, Kathleen Savio, and is suspected by Illinois State Police of killing his missing fourth wife, Stacy Peterson.

He's being held on a $20 million bond.
