Antonio Cross, 39, was charged after being released from the hospital

UPDATE: Woman shot by off-duty officer has died...

A man shot by an off-duty detective early Wednesday faces aggravated assault charges, Chicago Police said.

Antonio Cross, 39, of the 7100 block of South Ridgeland Avenue was charged Wednesday night after being released from the hospital. Cross was one of two people shot after the off-duty detective noticed a disturbance around 1:05 a.m. on Chicago's West Side.

According to Police News Affairs, the detective was driving at about 1:05 a.m. near the 3100 block of West 15th Place when he noticed several people causing a disturbance.

Police said the officer rolled down his window to investigate and saw Cross approach him with a handgun.

"The officer announces, 'Police, drop the gun,' but the offender continues to advance on him," said Fraternal Order of Police spokesman Pat Camden on Wednesday. "At that point the officer fires in fear of his life."

One of Cross' family members told NBCChicago Wednesday his cousin had a cell phone, not a gun.

Police said further investigation revealed a woman also sustained a gunshot wound. The man was taken to Mount Sinai Hospital where he was in good condition Wednesday morning.

The condition of the woman is unknown.
