A former Schaumburg police officer that was said to go on trial Tuesday on charges that he sold illegal drugs after seizing them from dealers, was instead dismissed from the DuPage County Courthouse Tuesday afternoon.
John Cichy was arrested back in 2013 along with Matthew Hudak and Terrance O’Brien after the drug dealer they used to re-sell the drugs they confiscated, acted as a confidential informant.
It was the use of that informant that defense attorney’s believe may have helped in the decision to dismiss the case.
The DuPage County State Attorney cited moral, ethical and legal obligations in announcing that he would not proceed with the criminal prosecution against Cichy.
“The evidence against Mr. Cichy is different than his co-defendants and recent developments in this five-year-old case led me to this decision,” said DuPage County State Attorney Michael Berlin.
Hudak and O’Brien however, pleaded guilty to the crimes and are serving 26 and 24 years respectively.
“The developments in Mr. Cichy’s case will have no impact whatsoever in the pleas and sentences involving Mr. Hudak and Mr. O’Brien,” said Berlin.

The other two former officers’ attorneys were granted an order by the judge to preserve all the evidence in the Cichy case.
At this time, it is unclear whether or not it could have an impact on their respective cases.
