Lawyer: NIU Frat Members Won't Get Jail Time For Student's Death

An attorney for the family of a Northern Illinois University student who died after a party says five fraternity members charged in his death won't face jail time per plea agreements.

Nineteen-year-old pledge David Bogenberger died at the Pi Kappa Alpha fraternity house in 2012. A toxicology report said his blood-alcohol content was 0.351 percent. The NIU chapter of the fraternity was closed.

The lawyer for Bogenberger's family says authorities and fraternity members have reached a plea agreement that would see the five sentenced to a form of non-reporting probation, the Daily Chronicle reports. They were charged with felony hazing. Seventeen others face less serious charges.

A judge could accept the plea agreement at a sentencing hearing scheduled for May 8.

DeKalb County State's Attorney Richard Schmack declined to comment.
