Official Rules

October 14, 2013—December 15, 2013

 

PRELIMINARY INFORMATION:  NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. Void outside the WMAQ terrestrial geographic viewing area and where prohibited. The CHICAGO HISTORY BOWL SWEEPSTAKES (“Sweepstakes”) will begin on October 14, 2013 at 12:00 P.M CT and end on December 15, 2013 at 11:59 P.M CT (“Sweepstakes Period”).  All times in the Sweepstakes refer to Central Time (“CT”). Odds of winning depend upon the number of eligible entries received.  Sweepstakes is subject to all applicable federal, state and local laws. PRIZE DOES NOT INCLUDE TRANSPORTATION OR PARKING.

ELIGIBILITY: Open only to permanent, legal United States (“U.S.”) residents who are physically located in the WMAQ terrestrial geographic viewing area in the counties of Cook, De Kalb, Du Page, Grundy, Kane, Kankakee, Kendall, Lake, La Salle, McHenry, and Will in the state of Illinois; and Jasper, Lake, La Porte, Newton, and Porter in the states of Indiana and Illinois, and who are eighteen (18) years of age or older as of the start of the Sweepstakes Period.  Officers, directors, and employees of Sweepstakes Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Sweepstakes.  Sweepstakes Entities, as referenced herein, shall include WMAQ, 454 N. Columbus Drive, Chicago, IL 60611; NBCUniversal Media, LLC, 30 Rockefeller Plaza, New York, NY 10112; and Chicago History Museum  (collectively, “Sponsors”), and their respective parent, subsidiary, and affiliate companies, their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.

TO ENTER: There are four (4) phases (each a “Phase”) of this Sweepstakes Period and three (3) methods of entry during each Phase. Limit one (1) entry per Phase of Sweepstakes Period, regardless of method, for a total of four (4) entries into Sweepstakes.

PHASE I:  Phase I (“Phase I”) of the Sweepstakes Period runs from 12:00 P.M. CT on October 14, 2013 through 11:59 P.M. CT on November 3, 2013. Phase I involves submitting ideas for a future Chicago History Museum exhibit (“Exhibit”).

Facebook Entry: Enter the Sweepstakes during Phase I by visiting the NBC Chicago Facebook page located at http://www.facebook.com/nbcchicago (the “Website”) and clicking the “Like” button to become a fan of NBC Chicago. Then access the Sweepstakes tab (“Sweepstakes Tab”) within the Website and follow the provided instructions to complete and thereafter submit the entry form, which includes your name, email address, date of birth, and in 100 characters or less, submit a statement  (“Statement”) of  your idea for a future Exhibit (“Entry I”). Statement will not affect your chances of winning. 

Email Entry: Entry I can also be submitted by sending an email to historybowl@chicagohistory.org with the same information: your name, email address, date of birth, and Statement of your idea for what a future Exhibit should be. Statement will not affect your chances of winning.

Physical Mail Entry: Entry I can also be submitted by sending a letter or postcard to: Attention Chicago History Museum, 1601 North Clark Street, Chicago, IL 60614-6038, with the same information: your name, email address, date of birth, and Statement of your idea for what a future Exhibit should be. Statement will not affect your chances of winning.

Statement becomes property of Sponsors, and will not be acknowledged or returned. Statement must be original (that is, your idea). By entering the Sweepstakes, entrants grant Sponsors the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit the Statement and to incorporate the Statement in other works in any and all markets and media worldwide in perpetuity.  Entrants warrant that they have the sole and exclusive right to grant such rights to Sponsors and that the Sponsors' reproduction, publishing, displaying, and/or other use of the Statement will not infringe on any rights of third parties, including, without limitation, copyright, trademark, privacy, or publicity, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract.  Sponsors shall have no obligation to copy, publish, display, or otherwise exploit the Statement. 

Sponsors will group related Statements into sixteen (16) subject areas for public voting in later Phases of Sweepstakes (described below). Each Phase will narrow the voting pool until a final idea is selected in the last round of voting. Entrants will not receive recognition for Statement. The idea with the most votes will become a future exhibit at the Chicago History Museum. Statements that are inappropriate for a family audience or inconsistent with the mission of “Sharing Chicago Stories” will not be considered for Exhibit.

PHASE II: Phase II (“Phase II”) runs from 12:00 P.M. CT on November 11, 2013 through 11:59 P.M. CT on November 17, 2013. Phase II involves public voting for one of sixteen (16) choices for a future Exhibit.

Facebook Entry: Enter the Sweepstakes during Phase II by visiting the Website, and clicking the “Like” button to become a fan of NBC Chicago. Then access the Sweepstakes Tab within the Website and follow the provided instructions to complete and thereafter submit the entry form, which includes your name, email address, date of birth, and a vote for one of sixteen (16) choices for a future Exhibit (“Entry II”). Vote will not affect your chances of winning.

Email Entry: Entry II can also be submitted by sending an email to historybowl@chicagohistory.org, with the same information: your name, email address, date of birth, and a vote for one of sixteen (16) choices for a future Exhibit. PHASE III: Phase III (“Phase III”) runs from 12:00 P.M. CT on November 25, 2013 through 11:59 P.M. CT on December 1, 2013. Phase III involves voting for one of eight (8) ideas for a future Exhibit.

Facebook Entry: Enter the Sweepstakes during Phase III by visiting the Website, and clicking the “Like” button to become a fan of NBC Chicago. Then access the Sweepstakes Tab within the Website and follow the provided instructions to complete and thereafter submit the entry form, which includes your name, email address, date of birth, and a vote for one of eight (8) choices for what a future Exhibit should be (“Entry III”). Vote will not affect your chances of winning.

Entry I, Entry II, Entry III, and Entry IV (collectively “Entries”)  must be received before cutoff time for each Phase, as detailed above, to be eligible for the Sweepstakes. Sponsors’ computer shall be the official timekeeper for all matters related to this Sweepstakes. You may enter one (1) time per Phase during the Sweepstakes Period, for a total of four (4) Entries. Multiple Entries received from any person or Facebook account beyond this limit will void all such additional Entries. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. “Authorized account holder” is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval. All Entries become the property of Sponsors and will not be acknowledged.

PRIVACY: Entrants will have the opportunity to receive information from Sponsors and selected partners by checking the appropriate box(es). If, at any time, you no longer wish to receive materials from WMAQ or our partners, please go to our privacy policy, located at http://www.nbcchicago.com/privacy/, or the applicable partner’s privacy policy and follow the procedures indicated.

WINNER SELECTION AND NOTIFICATION: On or about December 16, 2013, one (1) potential winner (“Winner”) will be selected in a random drawing by representatives of Sponsors from all eligible entries received during the Sweepstakes Period. Sponsors will make two (2) attempts to notify potential Winner at the phone number and/or email address submitted at the time of entry.  Potential Winner may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Sweepstakes Documents”) within seven (7) days of such notification.  Noncompliance within this time period will result in disqualification, and, at Sponsor’s sole discretion an alternate potential Winner may be selected from the remaining eligible entries. If potential Winner cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, potential Winner will be disqualified and time permitting, at Sponsor’s sole discretion, an alternate potential Winner may be selected from the remaining eligible entries. 

PRIZE:  There will be one (1) prize awarded (“Prize”). Prize consists of the following: A two (2) night stay, standard room, double-occupancy, at the Palmer House, located at 17 E Monroe St, Chicago, IL 60603, for Winner and guest (“Guest”), and a one (1) year membership to the Chicago History Museum, located at 1601 N Clark Street Chicago, IL 60614. Transportation and parking are not included.

Estimated Retail Value (“ERV”) of Prize is four-hundred and sixty dollars ($460).  Actual Retail Value (“ARV”) of Prize may vary. Any difference between stated ERV and ARV will not be awarded.

All details of Prize will be determined by Sponsors in their sole discretion.  Sponsors reserve the right to substitute a similar Prize (or Prize element) of comparable or greater value. Prize is subject to certain terms and conditions as specified by issuer. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. All lodging will be at the risk of Winner and Guest. If Prize is unclaimed within a reasonable time after notification from Sponsors, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible entries at Sponsors’ sole discretion. Sponsors shall have the right, but not the obligation to make any deductions and withholdings that Sponsors deem necessary or desirable under applicable federal, state, and local tax laws, rules, regulations, codes, or ordinances.

If Winner chooses to travel with no Guest, the remaining elements of Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Guest, if any, may be required to execute and return releases of liability and, except where prohibited, publicity releases (collectively, “Guest Documents”), which must be returned with the Sweepstakes Documents, or Guest portion of the Prize will be forfeited. If any Guest is a minor, Winner must be such minor’s parent or legal guardian and must execute and return the Guest Documents on such minor’s behalf.

CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities and their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on http://www.nbcchicago.com/on-air/contests/ and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes at Sponsors’ sole discretion.

ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules.  Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.  Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules).  In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winner(s) in a random drawing from among all eligible, non-suspect entries received prior to the time of the event warranting such cancellation, modification, or suspension.  Notice of such cancellation, modification, or suspension will be posted at http://www.nbcchicago.com/on-air/contests/Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).  Sponsors reserve the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of this Sweepstakes.

DISPUTESThe Sweepstakes is governed by, and will be construed in accordance with, the laws of the State of New York, and the forum and venue for any dispute shall be in New York, New York. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”).  The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in new york.  All proceedings brought pursuant to this paragraph will be conducted in the County of new york.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

Voting Rules and Procedures

 

These Voting Rules and Procedures for the Chicago History Bowl Sweepstakes (“Sweepstakes”) are subject to change at any time at the sole discretion of WMAQ, NBCUniversal Media, LLC, and the Chicago History Museum (“Sponsors”). Void where prohibited. 

 

Voting (“Voting”) is simple and easy. There are three (3) ways to vote (described below) for what you think a future Chicago History Museum exhibit should be, including online Voting, email Voting, and physical mail Voting. By Voting, you will also be automatically entered into the Sweepstakes if you are eighteen (18) years of age or older. Voting will be conducted pursuant to these Voting Rules and Procedures and any such other rules and procedures as Sponsors may from time to time designate. 

 

Eligibility:  You must be 13 years of age or older to submit your vote (“Vote”). You must be eighteen (18) years of age or older to be entered into Sweepstakes through Voting.You must be a permanent legal resident of the United States and physically located in the WMAQ terrestrial geographic viewing area in the counties of Cook, De Kalb, Du Page, Grundy, Kane, Kankakee, Kendall, Lake, La Salle, McHenry, and Will in the state of Illinois; and Jasper, Lake, La Porte, Newton, and Porter in the states of Indiana and Illinois. Votes must be cast by the authorized account holder from which the Vote is made. 

 

Voting Period and Restrictions: Voting is open during three separate Voting periods (each a “Voting Period”) during three (3) phases (each a “Phase”) of the Sweepstakes. The Voting Periods are as follows:

Then access the Sweepstakes tab (“Sweepstakes Tab”) within the Website and follow the provided instructions to complete and thereafter submit your voting form (“Voting Form”), which includes your name, email address, date of birth, and vote for which idea you like for an upcoming Chicago History Museum exhibit. Website will display different Voting choices depending on the applicable Voting Period. Voting Period I will include sixteen (16) Voting choices. Voting Period II will include eight (8) Voting choices. Voting Period III will include four (4) Voting choices. You may submit your Vote during each Voting Period by accessing the Sweepstakes Tab within the Website and submitting your Voting Form. Click on the box next to your voting selection.  A checkmark will appear in the box confirming your selection. 

 

How to Vote Through Email: To submit your Vote through email, send an email to historybowl@chicagohistory.org with your name, email address, date of birth, and Vote for which idea you like for an upcoming Chicago History Museum exhibit. Voting voices will be available at http://www.nbcchicago.com/entertainment/the-scene/Vote-For-a-Future-Chicago-History-Museum-Exhibit-227097221.html?updated (“Voting Choices Website”). Email must be received by the cutoff time for each Voting Period, as indicated in the chart above.

 

How to Vote By Physical Mail: To submit your Vote through regular mail, send an postcard or letter to Attention Chicago History Museum, 1601 North Clark Street, Chicago, IL 60614-6038 with your name, email address, date of birth, and Vote for which idea you like for the upcoming an upcoming Chicago History Museum exhibit. Voting choices will be available at the Voting Choices Website. Mail must be received by the cutoff time for each Voting Period, as indicated in the chart above. 

General Conditions: WMAQ has the right, in its sole discretion, to void any Vote that appears, to have been made by a person not meeting the eligibility requirements set forth above, or that appears to be an automated or duplicate Vote, and has the right to permanently disqualify from any Voting any person it believes has violated these rules.  If for any reason the Voting is not capable of being run or implemented as planned, including, but not limited to, as the result of infection by computer viruses or bugs, tampering, unauthorized intervention, fraud, or any other cause beyond the control of WMAQ, which is likely to, or actually corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Voting, then WMAQ reserves the right, in its sole discretion, to withdraw the transmission of any Vote and/or to terminate or suspend the Voting at any point and declare the Voting results based upon the Votes up to that point.  In the event of technical difficulties with the Voting, including, but not limited to, mobile or Internet service interruptions, WMAQ reserves the right to review the Votes for accuracy and to take any appropriate action, including, without limitation, voiding the Votes cast during the time period in which such technical difficulties occurred.  WMAQ, NBCUniversal Media, LLC, their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and any other entity involved in the development or administration of the Voting, and each of their respective directors, officers, employees and assigns (collectively the “Released Parties”) are not responsible for any computer, network, technical, electronic, human or other errors or problems of any kind, for any injury or damage to participants or to any person’s computer or mobile phone relating to or resulting from Voting or downloading materials or software in connection with the Voting, or for Votes that are stolen, misdirected, garbled, delayed, lost, or late.  By participating, each individual agrees to release and hold the Released Parties harmless against any and all claims and liability of any kind arising in whole or in part, directly or indirectly, out of their participation in the Voting. 

Caution: Any attempt by you or any other individual to deliberately damage any online service, mobile phone service, or web site tamper with the Voting process, or otherwise undermine the legitimate operation of the Voting is a violation of criminal and civil laws and should such an attempt be made, Released Parties reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. 

Disputes:  THESE RULES, AND SUBMISSION OF YOUR VOTE, ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”).  THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK.  ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

Terms of Submission


WMAQ, located at 454 N. Columbus Drive, Chicago, IL 60611, and NBCUniversal Media, LLC, located at 30 Rockefeller Plaza, New York, NY 10112 (collectively, “NBCU”), invite you to join in on the fun with the Chicago History Museum (“Museum”) by giving you the opportunity to submit your idea (“Idea”) for a future Chicago History Museum exhibit through e-mail to
historybowl@chicagohistorymuseum.org, through sending a letter or postcard to Attention: Chicago History Bowl, Chicago History Museum, 1601 North Clark Street, Chicago, IL 60614-6038, or through WMAQ’s Facebook Page, http://www.facebook.com/nbcchicago (“Facebook Page”). In order to participate, you must be at least thirteen (13) years old. If you are under the age of eighteen (18) years old, you must obtain prior permission from your parent or legal guardian before submitting your Idea. If you are eighteen (18) years of age or older, you will automatically be entered into the Chicago History Bowl Sweepstakes (“Sweepstakes”) when you submit your Idea. By submitting your Idea, you agree that your Idea may be broadcast on WMAQ, may be used on the Facebook page, WMAQ’s website, www.nbcchicago.com, (“Website”), by the Museum, and in advertising on-air, off –air, and on the Website by NBCU or the Museum (together, the “Materials”), and that NBCU and the Museum may exploit your Idea and the Materials howsoever they choose in any and all markets and media now known or hereafter devised, throughout the world in perpetuity, without additional notification, permission, approval, or compensation. You understand that there will be no payment or recognition for the submission or use of your Idea.

 

Your Idea should be original and should not infringe on any third party rights, including without limitation, copyright, trademark, or patent, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract. You must have the permission of any person named in your Idea, or any person you identify or otherwise refer to in your Idea. Your Idea must comply with all applicable laws, rules, and regulations, and it must also comply with the Facebook terms of service. NBCU and Museum, in their sole discretion, may choose not to use or feature the Ideas. Ideas should be appropriate for a family audience and consistent with the mission of “Sharing Chicago Stories.”

 

You grant NBCU and Museum the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit your Idea and to incorporate your Idea in other works in any and all markets and media, now known or hereafter devised, throughout the world in perpetuity, without additional notification, permission, approval, or compensation. 

 

By submitting your Idea, you consent to the recording, use, and reuse by NBCU and the Museum, their licensees, successors, and assigns, of your Facebook name, voice, actions, likeness, name, appearance, biographical material, and any other identifying information, including without limitation, any information contained in your Facebook profile, as used, edited, altered, fictionalized, or modified by NBCU or Museum, in their sole discretion, in connection with NBCU and Museum, and in advertising and promotion for NBCU and Museum, in any media, worldwide in perpetuity.

You acknowledge and agree that NBCU and Museum, their licensees, successors, and assigns will be entitled to retain any and all revenue generated from any sales, licenses, assignments, and other transfers of the rights granted by you hereunder, as well as any and all revenue generated by the display of any advertising, publicity, promotional materials, or distribution rights in connection with your Idea or the Materials.  Nothing in these Terms of Submission obligates or may be deemed to obligate NBCU, Museum, or any other person or entity to use the Idea.  NBCU and Museum will have the right to make any changes to your Idea, as it determines in its sole discretion.  You agree that NBCU, Museum, their licensees, successors, and assigns, shall have no obligation to give you credit for your Idea, but in their sole discretion may elect to do so.

 

To the extent that the Website’s Term and Conditions of Use, located at http://www.nbcchicago.com/terms/ (the “Website Terms”), are not in conflict with these Terms of Submission, the Website Terms apply.
