Cop Blames Failed Drug Test on Oral Sex

Judge denies plea to reinstate officer

A veteran NYPD cop who says he tested positive for cocaine because he ingested it during oral sex with his girlfriend will not get his job back, according to the New York Daily News

Helicopter pilot Jon Goldin, a 15-year NYPD officer, claimed he got the drug in his system from “passive ingestion” while performing oral sex on his girlfriend Coreen McCarthy, who told him after the fact that she was a frequent cocaine user.

Goldin showed up positive for coke in a random test using hairs from his arm in October 2006. He lost his job two years later.

Goldin and McCarthy met at a punk concert; they called it quits immediately after he tested positive for cocaine, the Daily News reported.     

Goldin didn’t dispute the results of the test when it was first conducted, but sued to get his job back last year when a state appeals court shot down the use of hair in random drug testing for cops, the Daily News reported.

More than 70 friends stood up for the former cop, who they testified to be an upstanding individual with a “straight edge” lifestyle; they said Goldin often opted not to drink when they went out and hardly ever had even a sip of coffee, the paper reported.

“This is a very special human being who devoted his entire life to being a police officer," said Paul Goldberger, Goldin’s lawyer. "He would no more use drugs than the man on the moon."

A Manhattan judge didn’t buy Goldin’s argument. Supreme Court Justice Eileen Rakower said that although the appeals court declared hair tests impermissible in December 2007, Goldin’s firing would stand because he voluntarily submitted to the drug test and permitted the hairs to be taken from his arm.

The high court agreed this week to review an NYPD appeal in favor of reinstituting hair testing for illegal drugs.
