It's a bitter defeat for the "Borgata Babes." Thanks to a judge's ruling, the Atlantic City Casino has the right to fire their female employees if they gain too much weight. But the judge's decision has gotten a mixed response from customers. NBC10's George Spencer has the story.

An Atlantic City casino can control how much weight that its cocktail servers gain.

A state judge says the Borgata Hotel Casino & Spa's rules are reasonable.

Twenty-two servers, known as "Borgata Babes," objected to the policy, which prohibited the 'Babes' from gaining more than 7 percent of their original body weight. They said the casino only attempted to enforce it on female servers.

"I think it's way too stringent," said former "Borgata Babe" Rene Gaud. "I think it's a way to get rid of the older girls."

The Press of Atlantic City reports the judge found the rule would be considered sexist if the policy targeted female servers only or punished a trait in one sex over another.

The judge found neither was evident in the case and instead said that maintaining a certain weight is part of what the women agreed to do as entertainers.

"I couldn't agree more," said Sean Murphy of Atlantic City. "It's a marketing business. You gotta sell yourself."

"It's kind of 50/50," said Stephanie Murphy. "If they were hired knowing that they had to maintain a certain appearance and they didn't, that's one thing."

Others disagreed however.

"Skinny girls aren't in style no more," said Tanya Myers. "They like the big and thick chicks!"

While the judge said the Borgata's rules aren't discriminatory, some potential customers are still calling for a change in attitude.

"Just because you're big, doesn't mean you're not a babe," said Karen Myers.

"I'm fat," said Jessenia Rodriguez while laughing. "I don't want to be fired because of it."
