A woman who claims she was severely hurt by falling beer at a Mariano’s Fresh Market on the North Side last summer is suing the supermarket’s parent company.
Katie Kirby went to the Mariano’s at 3350 N. Western on July 28, 2013 to buy groceries, according to the lawsuit filed Thursday in Cook County Circuit Court.
Kirby claims she was reaching for a six-pack of beer in a refrigerator when another package of glass beer bottles fell and shattered on the floor. A large piece of glass sliced the peroneal tendon in her ankle, the suit alleges.
A representative for Roundy’s Supermarkets, which is Mariano’s parent company named as the defendant in the suit, could not immediately be reached for comment Thursday evening.
The suit says Kirby’s “severe and permanent injuries” were caused by the store’s overstocking of the beer refrigerator and improper shelf maintenance.
She is seeking $50,000 in damages, as well as court costs.
