Lawsuit Filed Against Airline After Plane Crashes Into Home

The negligence lawsuit claims the couple suffered “emotional trauma” in the crash

A Chicago law firm has filed a lawsuit on behalf of an elderly couple whose home was damaged when a plane crashed into it near Midway Airport last week.

Corboy and Demetrio filed the lawsuit on behalf of Roberta Rolinskas, 82, and Raymond Rolinskas, 84 Tuesday against Central Airlines, Inc., which owns the plane that crashed.

The couple was in the bedroom of their home on Chicago's Southwest Side last week when a small plane dove out of the sky and crashed into their home, coming within eight inches of where they were sleeping, Assistant Deputy Fire Commissioner Michael Fox said.

The negligence lawsuit claims the couple suffered “emotional trauma” in the crash.

“While thankfully Roberta and Raymond did not suffer any physical harm, the emotional trauma has been devastating to them,” Matthew Jenkins of Corboy & Demetrio said in a statement. “Hearing, seeing and feeling an airplane crashing just inches away from them has caused severe emotional distress.”

The law firm says it has obtained a protective order to preserve the plane, including radar reports, voice recordings and other communication evidence along with general maintenance records.

Central Airlines Inc. could not immediately comment on the matter.
