Dugan Eligible for Death Penalty

Brian Dugan is not a typical killer.

Brian Dugan is eligible to be put to death, a jury concluded today.

After just one hour of deliberation 12 men and women from DuPage concluded that Dugan, who pleaded guilty to kidnapping, raping and murdering 10-year-old Jeanine Nicarico in 1983 is eligible for the death penalty.

This is the first step in the process. Next the prosecution will have to make its case for why he should be put to death as his trial moves into the sentencing phase.

They'll waste no time. The prosecution will begin arguing for the death penalty this afternoon. It's expected to last between four and six weeks.
