Family Sues Kmart After Woman Dies of MRSA Following Cut From Shelf

A woman’s family claims in a a lawsuit she died after contracting the antibiotic-resistant infection MRSA when she cut her leg on a shelf at a downstate Kmart store.

Dolores Thompson was driving a store-provided motorized scooter on Nov. 15, 2012 when she “lacerated her right leg on a metal shelving unit when attempting to evade boxes” in a Kmart aisle, according to the suit filed by David Thompson, the woman’s son and administrator of her estate.

The alleged incident happened at a now-shuttered Kmart at 11 Northpoint Dr. in Streator, about 50 miles southwest of Joliet, according to online records.

On Dec. 2 of that year, doctors detected methicillin resistant staph aureus, or MRSA, in the wound on her leg, and she died of MRSA sepsis in Cook County on April 15, 2014, the suit claims.

A representative for Sears Holdings Corp.—Kmart’s parent company, which is also listed as a defendant—said the company had not received or reviewed the suit as of Friday morning, and could not comment on it.

The four-count wrongful death suit claims negligence and seeks at least $200,000 in damages, plus court costs.
